Consumer Protection: Sample Letter to Manufacturers

The passing of the Consumer Protection bill SB0378/HB403 will be bringing changes to packaging for Hemp products sold in Tennessee. With a little over a year, before the law goes into practice, there’s no better time than now to start acting on the needs of 2024 in the TN Hemp Market.

The Policy Board at Cultivate Tennessee has crafted a sample letter you can edit and send to manufacturers for the products you sell in your retail business.

Dear [Manufacturer],

I am writing to you today to inform you of upcoming changes to packaging requirements for our retail products. As of July 1, 2024, a new bill will go into effect in our state that will impact the way we package and label our products containing hemp-derived cannabinoids.

The new legislation requires all packaging for these products to include the following information:

  • Packaging must be child-resistant and meet all applicable federal, state, and local packaging requirements.

  • Be labeled with various warnings and disclaimers:

    • expiration date

    • list of ingredients and possible allergens

    • nutritional fact panel

    • the total amount of hemp-derived cannabinoids in the entire package

    • code that can be scanned to access a website providing certain information, including the method of analysis for the testing report required under this bill.

  • Serving size 25mg or less, in the aggregate, of one or more hemp-derived cannabinoids

  • Any cannabinoid product can not be in the shape of an animal or cartoon character.

As one of our valued manufacturers, we request that you review your current packaging practices and make any necessary changes to ensure compliance with the new law. We understand that this may require some adjustments to your manufacturing process, but we believe that the benefits to the customers are worth the effort.

Please let us know as soon as possible what steps you will be taking to ensure your products comply with the new packaging requirements. We are committed to providing our customers with safe and legal products, and we believe that by working together we can meet these new standards and continue to offer high-quality products to our customers.

If you have any questions or concerns about the new law or how it may affect your business, please do not hesitate to contact us. We are happy to discuss this further with you and provide any assistance we can.

I’m also linking the full bill summary and a blog from Cultivate Tennessee to reference.

Thank you for your attention to this matter.

Sincerely,
